These terms apply to all services provided by ETS Mondésir: solar installation, product sales, import services, consulting and training. Any order implies full acceptance of these terms. These terms prevail over any other document not expressly agreed in writing by ETS Mondésir.
All prices are stated in FCFA and include applicable taxes. A written quote is provided before any work. Payment is made in two stages: a deposit of 30% to 50% on order, and the balance on delivery or completion. ETS Mondésir never requests 100% payment in advance. A receipt or invoice is issued for every payment.
Local deliveries: 24 to 72 hours. International imports: 3 to 8 weeks depending on origin and customs. Timelines are indicative and may be extended by force majeure events (port strikes, customs delays, natural events) which will be communicated promptly to the client. Risk transfers to the client upon delivery.
Products benefit from manufacturer warranty according to their specifications. Solar installations carry a 6-month labour guarantee. Returns are accepted within 7 days for products in original condition with proof of purchase. Returns do not apply to custom orders or perishable goods.
ETS Mondésir's liability is limited to the amount of the relevant transaction. Indirect damages (loss of profit, business interruption) are excluded. For import intermediation, ETS Mondésir has a best-efforts obligation and cannot be held liable for supplier defaults beyond our control, provided all due diligence was performed.
In the event of a dispute, the parties agree to seek an amicable resolution within 30 days. Failing that, mediation through the Brazzaville Chamber of Commerce is preferred. Absent resolution, disputes are submitted to the competent courts of Brazzaville. Applicable law: Congolese law and applicable OHADA Uniform Acts.
